1. Registration and user account

To use the Software, the User must complete registration by creating a personal account and providing truthful, up-to-date, and complete information. The User is responsible for the accuracy of the data provided and undertakes to update it promptly whenever it changes.

2. Credential security

The User is the sole custodian of their login credentials (email and password). Sharing credentials with third parties is prohibited. Any activity carried out through the User's account is deemed to have been carried out directly by the User, who holds Traicker.io harmless from any claim arising from the loss or theft of those credentials.

3. License and intellectual property

Traicker.io grants the User a limited, personal, non-exclusive, non-transferable license to access the platform via a web browser for professional or personal purposes, depending on the subscribed plan. All trademarks, logos, text, software, and graphics on the Site and within the Platform are the exclusive property of Areaweb S.r.l. or its licensors and are protected under copyright law.

4. Prohibited activities and proper use

The User is strictly prohibited from using the Site and the Software to:

• Upload, publish, or transmit unlawful, defamatory, obscene content or content contrary to public decency;
• Introduce viruses, malware, trojans, or other malicious code capable of compromising the integrity of Areaweb's systems or those of third parties;
• Run unauthorized vulnerability scans or penetration tests against the Platform;
• Exploit or resell the services without Areaweb's express written consent.

5. Service availability and updates

Areaweb S.r.l. undertakes to keep the platform accessible but does not guarantee it will be free of interruptions due to scheduled or unscheduled maintenance, network malfunctions, or force majeure. The software is provided "as is" and may be updated or functionally changed over time to improve the service.

6. Payments and subscriptions

Fees for Traicker.io's pricing plans are shown on the Site. Subscriptions are paid in advance. Unless stated otherwise, prices shown on the Site are exclusive of VAT.

7. Account cancellation and suspension

The User may cancel their account at any time from the Platform's control panel. Data is retained and then deleted in accordance with the privacy policy. Areaweb reserves the right to suspend or cancel the User's account with immediate effect in the event of an actual or suspected breach of these Terms, with no refund due for any remaining subscription period.

8. Limitation of liability

To the maximum extent permitted by law (including the Italian Consumer Code where applicable), Areaweb is not liable for any direct or indirect, financial or non-financial damage arising from the use or inability to use the platform, nor for data loss or technical malfunctions attributable to third parties or to the User's misconfiguration.

9. Privacy and cookies

Personal data collected from the User through the Site is processed in strict compliance with EU Regulation 679/2016 (GDPR) and applicable Italian law, as further described in the Privacy Policy and Cookie Policy available in the Site's footer.

10. Links to third-party services

The Site or the Software may integrate or contain links to third-party services, APIs, or websites. Areaweb S.r.l. has no control over them and assumes no responsibility for their availability, security, or content.

11. Governing law and jurisdiction

These Terms are governed by Italian law. Any dispute arising from the interpretation or performance of these Terms is subject to the exclusive jurisdiction of the Court of Brescia, without prejudice to consumers' right to bring proceedings before the court of their own domicile.
